These Terms govern your use of the NearTalent Canada website at neartalentlatam.com/ca and any service we provide to Canadian clients. By using the site or engaging us, you agree to these Terms.

1. Who we are

NearTalent is a recruitment service operated by Selection Book S.L. ("we"). Selection Book is incorporated in Spain. For Canadian clients, all engagements are governed by Ontario law as set out below.

2. What we offer

NearTalent connects Canadian companies with pre-screened Latin American talent (engineers, marketers, designers, data and operations professionals). We provide sourcing, screening, interview coordination and contracting support. We are not an Employer of Record (EOR) — for EOR services we partner with third-party providers and pass through their terms.

4. Candidate placement guarantee

If a placed candidate departs within the first 90 days for reasons other than client-initiated termination, we will source a replacement at no additional placement fee. Detailed terms in the Service Agreement.

5. Intellectual property

All content on this site (text, design, code, schema, OG assets) is the property of Selection Book S.L. and is protected under Canadian and international copyright. You may share links but may not republish substantial extracts without written permission.

6. CASL — commercial electronic messages

By submitting your email through any form on this site, you give implied consent under CASL for us to respond to your inquiry once. Continuing commercial communications require separate express opt-in, which you control via the consent checkbox.

7. Limitation of liability

To the maximum extent permitted under Ontario law, our aggregate liability for any claim arising from the service is limited to the fees paid in the 12 months preceding the claim. We are not liable for indirect, incidental or consequential damages.

Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be excluded under applicable Canadian law (including, where applicable, the Ontario Consumer Protection Act).

8. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts of Toronto, Ontario have exclusive jurisdiction over any dispute arising from these Terms, except where mandatory Canadian consumer protection law provides otherwise.

9. Changes

We may update these Terms; material changes will be flagged on this page with a new "last updated" date. Continued use after changes constitutes acceptance.
