Privacy Policy — PIPEDA Compliant
NearTalent (a service of Selection Book S.L., "we", "us") handles personal information in accordance with Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and substantially similar provincial privacy laws (Alberta PIPA, BC PIPA). This policy explains what we collect, why, how we use it, and your rights.
1. Accountability
Selection Book S.L. is the controller responsible for personal information collected through this Canadian website. Our Privacy Officer can be reached at privacy@neartalent.com.
2. Identifying purposes — what we collect and why
2.1 Visitors to this site
- Technical data (IP address, browser, device, pages visited) — to operate the site and detect abuse. Legal basis: legitimate interest.
- Contact data if you fill a form or email us (name, work email, company, role description) — to respond to your inquiry. Legal basis: consent and contract preparation.
2.2 Candidates
- CV, work history, references, technical assessment results, English-language assessment, salary expectations, country of residence.
- Used to evaluate fit for client roles. Shared with potential clients only after candidate's express written consent for each specific role.
2.3 Clients
- Hiring brief, role requirements, contract billing details, contact information of hiring managers.
- Used to deliver our recruitment service and invoice for it.
3. Consent
We collect personal information with your knowledge and consent. Express consent is required for sensitive uses (sharing your CV with a specific client, sending commercial electronic messages). Implied consent applies for service operation where reasonable.
You may withdraw consent at any time by emailing privacy@neartalent.com. Withdrawal may affect our ability to provide service.
4. Limiting collection and use
We collect only what is necessary for the identified purposes. We do not use your data for unrelated purposes without obtaining fresh consent.
5. CASL — commercial electronic messages
We comply with Canada's Anti-Spam Legislation. Marketing emails go only to recipients who have given express opt-in consent. Every commercial email includes:
- Identification of the sender (Selection Book S.L. operating as NearTalent)
- Mailing address and contact information
- Functional unsubscribe link processed within 10 business days
Single transactional responses (e.g. answering your inquiry) are not commercial electronic messages under CASL and do not require prior opt-in.
6. Cross-border data transfers
Personal information may be processed in jurisdictions outside Canada including Spain (where Selection Book S.L. is incorporated), the United States (some service providers), and Latin American countries (where candidates reside). When data crosses borders we use contractual safeguards equivalent to PIPEDA's protections. You may request details of specific transfers by contacting our Privacy Officer.
7. Safeguards
We protect personal information with administrative, physical, and technological measures proportional to its sensitivity: access controls, encryption in transit (TLS 1.3) and at rest, role-based permissions, signed Data Processing Agreements with sub-processors, and regular security review.
8. Retention
- Candidate profiles — retained for 24 months after the last interaction unless you request earlier deletion.
- Client records — retained for the duration of the relationship plus 7 years for tax and accounting purposes (CRA requirement).
- Web analytics — aggregated after 14 months; identifiable IP-linked data deleted at 14 months.
9. Your rights under PIPEDA
- Access — request a copy of the personal information we hold about you
- Correction — request that we correct inaccurate or incomplete data
- Withdrawal of consent — subject to legal or contractual restrictions
- Complaint — to our Privacy Officer, and if unresolved, to the Office of the Privacy Commissioner of Canada (priv.gc.ca)
We respond to verified access requests within 30 days, free of charge for reasonable requests.
10. Cookies
This site uses strictly necessary cookies for navigation and security. We do not deploy advertising or tracking cookies. Analytics are aggregated and IP-anonymized.
11. Changes to this policy
Material changes will be announced on this page with a new "last updated" date. Continued use after changes constitutes acceptance.
